President Signs 21st Century Cures Act Into Law
President Obama has signed into law The 21st Century Cures Act (H.R. 34), intended to expedite and streamline the FDA approval processes, provide funds to accelerate the discovery, development, and delivery of new treatments and cures, and authorize discretionary funding for the NIH and FDA.
The legislation includes two important provisions supported by OOSS and the ASC community:
• The bill excludes patient encounters in ambulatory surgery centers from a
physician’s Medicare EHR Meaningful Use reporting and the forthcoming
Merit-Based Incentive Payment System (MIPS). The EHR provision will
insulate physicians who provide surgery in an ASC from penalties linked to
the Medicare meaningful use program.
• The measure also mandates that HHS establish a public, searchable web
site that enables Medicare beneficiaries to compare differences in their
out-of-pocket costs and total expenditures for procedures that are performed
in both ASCs and hospital outpatient departments. This initiative should
enhance the patient’s ability to comparison shop for surgical services,
identifying cost-effective treatment and lowering cost-sharing obligations.
